GENERAL TERMS OF USE AND GENERAL TERMS OF SALE
Éditions Cybernetica, represented by Tariq Krim, SIREN 481938165, offers on its Site (thesovereignway.eu) an online subscription service to the content published on the Site.
This Service is governed by these General Terms of Sale (hereinafter the "Terms"), to the exclusion of any other document or condition. Any consultation of the Site, and any subscription or renewal taken out from the Site, implies the Subscriber's full and unreserved acceptance of these Terms.
ARTICLE 1 – PRODUCT AND SERVICE OFFERS
The offers in force are those displayed on the day the order is registered, under the conditions indicated, Éditions Cybernetica reserving the right to modify them at any time.
Any subscription to an offer is subject to acceptance of our General Terms of Sale.
1.1 – Annual subscription plans
The subscription is annual, and subscription and payment are made online.

1.2 – Terms of subscription for the annual subscription
The Subscriber's validation of their order constitutes full and unreserved acceptance of these General Terms. The data recorded by Éditions Cybernetica across the Site constitutes proof of all transactions made between Éditions Cybernetica and its Subscribers, whether direct or indirect (through a third party).
The data recorded by the payment system constitutes proof of the financial transactions.
A subscription confirmation will be sent to the email address provided, setting out the contractual information, in particular the exact amount charged and the terms of the offer.
This subscription confirmation constitutes acceptance of the order by Éditions Cybernetica and validates the transaction.
The Subscriber acknowledges that the data recorded on the Site constitutes proof of the transaction (subscription and subscription date), and that the data recorded by the payment system described below constitutes proof of the financial transaction.
Accepting cookies is required for any subscription on the Site.
ARTICLE 2 – PAYMENT TERMS
2.1 – Payment methods
The Subscription is provided at the prices in force shown on the Site on the day the order is registered by the Seller, Éditions Cybernetica reserving the right to change its prices at any time.
Prices are expressed in euros, all taxes included.
Payment of the annual subscription:
The price is payable in cash by the Subscriber, in full, on the day the order is placed.
Payment by bank card through a secure payment server (Carte Bleue, Visa, MasterCard).
The payment provider is Stripe.
Payment made by the Subscriber will only be considered final once the Seller has actually received the sums due.
2.2 – Withdrawal
The subscription has a minimum initial term of 1 year.
In accordance with Article L221-28 13° of the French Consumer Code, the Subscriber expressly acknowledges and accepts, by accepting these General Terms of Sale when registering, that the provision of the service begins immediately after validation of their subscription, and consequently acknowledges and accepts that they do not benefit from the right of withdrawal and the fourteen clear days' period applicable to online or distance selling as provided for in the Consumer Code.
Consequently, no request for withdrawal, cancellation or refund will be accepted for the period subscribed.
2.3 – Termination and renewal
Subscriptions are automatically renewed when they expire. The Subscriber may under no circumstances terminate the subscription before its expiry date.
ARTICLE 3 – THE CONTENT OF THE SOVEREIGN WAY SITE
3.1 – Intellectual property
All content (texts, images, photographs, infographics, slideshows, videos…) made available on the Site and its variants, all programs and/or technologies provided in connection with the Site and, more generally, all or part of the Site are protected by intellectual property rights, worldwide. Taking out a subscription does not transfer any of these intellectual property rights to the Subscriber, whoever they may be. Only use for private and non-collective purposes, under the conditions set out in Article 2 of these General Terms, is authorised.
Consequently, the Visitor or Subscriber agrees not to:
1) reproduce and/or use the trademarks and logos on the Site without authorisation,
2) copy, modify, translate, reproduce, distribute, sell, publish, exploit in any other way, or distribute in another format, in electronic or other form, all or part of the content (even partially) on the Site,
3) distribute within their company, or to any third party whatsoever, a press review and/or press digest including all or part of the information on the Site;
4) assign any right whatsoever in all or part of the Site's content to a third party.
Violation of these mandatory provisions constitutes infringement and exposes the offender, and any person responsible, to the criminal and civil penalties provided for by law.
3.2 – Limitation of liability
Éditions Cybernetica provides its services in the context of publishing a website and of subscription and renewal contracts in accordance with the French regulations in force. It cannot be held liable for failure to comply with the legislation of another country.
In the online sales process, Éditions Cybernetica is bound only by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption or other involuntary problems.
Éditions Cybernetica shall in no event be liable to the visitor or Subscriber for indirect, consequential, special, incidental or punitive damages, loss of information or problems arising during electronic payment, or costs related to a delay, whatever the cause, based on any theory of liability (including formal, contractual, tortious, or consequential on damage within the limits permitted by law and caused by negligence), arising from this contract.
3.3 – Force majeure
Neither Éditions Cybernetica nor any third party involved in providing the service shall be held liable for any failure or delay in performing their obligations under the General Terms resulting from causes beyond their control, including without limitation force majeure, acts of civil or military authorities, fires, floods, riots, sabotage, network failures, electronic file coding errors, software limitations or inability to obtain telecommunication services, or government measures, provided, however, that the parties concerned take all reasonable steps to mitigate the effects of such situations.

ARTICLE 5 – PERSONAL DATA PROTECTION
The author and publisher of The Sovereign Way Site respects the privacy of its Subscribers.
To benefit from the products and services of Éditions Cybernetica, the Subscriber must accept the General Terms of Use and Sale for the use of the Site and give their consent to the processing of their personal data after reading the personal data protection policy.
Any access to the Site and any online purchase constitutes consent to these Terms.

ARTICLE 6 – GENERAL PROVISIONS
Entire agreement: the General Terms represent the entire agreement between the Subscriber and Éditions Cybernetica regarding their subject matter. For any dispute relating to interpretation, performance, termination or cancellation, both parties will endeavour to reach an amicable agreement.
The Subscriber and Éditions Cybernetica acknowledge and agree that the warranty exclusions, as well as the limitations of liability and remedies set out in the General Terms, are tangible and form the basis of the General Terms.
These Terms are governed by French law. In the event of a dispute, the Commercial Court of Paris shall have sole jurisdiction.
Éditions Cybernetica reserves the right to modify these Terms at any time. Any new General Terms of Sale will be brought to the Subscriber's attention by being updated online and will apply only to sales made after the modification. The Terms of Sale currently in force are accessible at any time on the Site.
